Personal Waiver

By purchasing a retreat adventure from ELong Retreats LLC you agree to the following statement:

I claim full responsibility for my safety and my body and I acknowledge that I understand that Pilates bodywork includes physical movements, as well as an opportunity to mindfully connect to Pilates exercises through resisted movements which may or may not include the use of latex stretchy bands, stability balls, 2 or 3 pound weights, fitness rings, Pilates Reformers, Pilates
jumpboard, Pilates stability boxes, Pilates stability chair; the Pilates Cadillac/Tower and MOTR machinery, and/or other exercise equipment. I understand that by integrating these potentially new exercises to my body that I may be able to re-educate my skeletal posture through muscular activation but that such posture re-educated is not guaranteed. As is the case with any physical activity, the risk of injury to me or to third parties, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body and respond to its needs by modifying or regressing the exercise to my physical capability, and, if necessary, ask for support from the Instructor or staff. I affirm that I alone am responsible to decide whether to practice Pilates either on or off the equipment and/or on the yoga mat. I HEREBY AGREE TO IRREVOCABLY RELEASE AND WAIVE ANY AND ALL CLAIMS THAT I HAVE NOW OR HEREAFTER MAY HAVE AGAINST ELong Retreats LLC, it’s instructors and staff regarding any and all physical and/or mental injuries that I may suffer while at the retreat. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to personally bear the costs of such injury or damage to myself. I further certify that I have no medical or physical condition which could interfere with my safety in the Pilates movement, or else I am willing to assume and bear the costs of all risks that may be created, directly or indirectly by any such condition.

RETREATS

TERMS OF SERVICE

This page will answer your questions with regards to ELong Retreat’s terms of service. It is your responsibility to fully understand the terms and conditions for each of our retreats set out at www.elongpilates.com (henceforth referred to as “the website”). Should you have any other questions regarding the terms and conditions of ELong Retreats LLC (henceforth referred to as ELR), we are available for consultation and would be happy to clarify any areas in advance of signing a contract with us.

PAYMENT TERMS, ITINERARY CHANGES AND CANCELLATIONS

Retreat pricing:
All prices are per person and set well in advance of the retreat start date. Prices vary depending on a variety of cost factors, with peak travel times being the most expensive. You can always find pricing on the website. Prices typically include retreat costs only. They do not include airfare to and from the retreat destination nor any ground transportation (unless otherwise specified on the website). Resort gratuities are never included in the retreat price. ELR believes in fair pricing for all retreat attendees.
All prices are set and non -negotiable.

Deposit and Payment terms:
We require you to reserve your placement in the retreat with a non-refundable US Dollar deposit (as specified per retreat and advertised on the website) per person. One month after your deposit is placed a secondary US dollar deposit payment is due towards your remaining balance. (This deposit will be specified and advertised on the website for the specific retreat in question.) The remaining balance will be billed three months prior to the start of the retreat (stated on the website). Final balances will be deducted from the credit card on file. If you book within the three – month period before the start of any retreats listed on the website, you will still be able to click the US dollar deposit box, but you will be billed for the secondary payment within 24 hours after putting down the initial deposit required to secure your placement.

Retreat payment can be made by credit card via the website. ELR will charge the retreat balance in full three months prior to the departure using the credit card on file. If the full payment is not received by the date stated on the website prior to the retreat start date, we reserve the right to cancel your reservation and fill your spot. We will make every effort to avoid this situation by contacting you prior to and on the day of the balance due date. If there is an immediate personal issue, please contact us at elongpilates@gmail.com.
Should any payment changes arise to previously submitted payment types, please contact ELR using the email address above. Please be prepared to provide your name, the specific retreat in question and the best way to contact you (email or phone). Do not submit credit card information over an email.

Itinerary changes:
ELR will make every effort to keep the original published itineraries, however we reserve the right to make changes. Events such as weather conditions/forecasts; “acts of God” and/or government travel restrictions could necessitate an alteration in the event itinerary, such as the dates. This will not constitute any reason for a refund. We will not offer refunds for itinerary changes to new dates and no refunds for unused services will be considered. In the event that you cannot make the new itinerary dates, we will offer you a full credit for use on any ELong retreats; the credit will expire on the two-year anniversary of the original itinerary date.

ELR reserves the right to correct printing errors and/or omissions at any time. Unaffected portions will continue to remain valid.

Cancellations:
ELR enforces a strict cancellation policy. If you wish to cancel your retreat, you must notify ELong Retreats in writing by contacting elongpilates@gmail.com. Your cancellation fee will be determined according to the time left before the retreat start date in order to fill your spot and to
cover any costs associated with reserving your spot at the retreat. Exceptions to our cancellation policy cannot be made for any reason. As examples, we do not offer exceptions due to: weather conditions; viruses and/or colds or flus that you might be contaminated with prior to departure including COVID and Zika viruses; health changes; personal emergencies including death of a loved one, or otherwise. There is no refund for arriving late or leaving the trip early.

You may request a transfer of your reservation from one ELong Retreat to another ELong retreat up to three months before the original listed retreat start date without penalty, after which time our strict cancellation policy will apply.

Retreat cancellations:
ELR reserves the right to make any changes deemed necessary including, but not limited to: staffing assignments, advertised excursions, arranged transportation, advertised meals, scheduled Pilates classes, etc. In the rare case of an ELong Retreat cancellation, ELR will offer a transfer to another ELong retreat or discuss other options. ELR is not responsible for any expenses or damages incurred as a result of retreat cancellation including preparation costs, airline tickets, travel documents or other expenses. ELR reserves the right to cancel any retreat prior to departure in the event that there are too few people booked, in which case you will be given a full refund of any and all payments made to ELR or the option to attend any other ELong retreat that has availability. You will not be entitled to claim any additional amounts or seek any compensation of any injury, loss, expenses or damages (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to: visa, passport and vaccination charges, or departure, gear expenses, airport and airline taxes.)

TRIP INSURANCE, DOCUMENTS AND IMMUNIZATIONS

Trip Insurance:
ELR encourages their guests to purchase individual travel insurance for international retreats. Residents from outside the U.S.A must check within your country for insurance coverage. Your deposit and any payments made within the three-month time stamp of the retreat start date are non refundable. Basic trip insurance will in most cases protect you for the full amount paid due to cancellation reasons covered by the insurance policy, such as severe weather or illness. Should you need to cancel for any reason not covered by the insurance policy (family or work related commitments, pre-existing medical conditions, pregnancy, etc), a “Cancel for Any Reason” add-on will typically reimburse you for a percentage of the prepaid, forfeited, non-refundable payments or deposits. This includes your airfare, deposit, and any additional payments if applicable.

ELR will not be held responsible for any delay, additional expense or inconvenience that may be caused directly or indirectly by events outside of our control (for example: late arrival/departure of flights, civil disturbance, fire, flood, cyclones, severe weather, “acts of God,”acts of government, machinery or equipment failure, or cancellations for any reason). No refunds will be given for “no shows” or days not used.

Travel documents and Immunizations:
It is the responsibility of each traveler to obtain all required travel documents including Visas unless otherwise noted. Information regarding necessary documentation is provided as necessary on our website or you can contact us for more detailed information.
It is your responsibility to purchase correct immunizations. Please contact your nearest travel clinic for the latest requirements.

ROOMMATES

Roommate assignments:
Retreat rates are per person. Double, triple, quad, bunk or otherwise advertised shared rooms require shared occupancy for the specified room rate. If you book a shared room without a specified roommate(s), we will do our very best to match you with your desired room type and price point. In the event we cannot find you a roommate of your first pick, we will present you with different rooming options.

I acknowledge the enjoyment and challenge I will receive from the activities in these ELong retreats, whether it be in the wilderness, with an opportunity to experience wildlife and nature and/or indoors surrounded by positive and mentally stimulating activities may cause an emotional reaction resulting from personal growth exploration. This is my reason for participating in an ELong retreat, and I voluntarily assume all risks associated with these activities and freely waive any and all legal rights that I may have against the releasees.

PHYSICAL TRAINING RELEASE OF LIABILITY

Express assumption of risk.

I am aware that any of these above mentioned risks may result in serious injury or death to myself and/or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering, or watching in any physical training, including this Pilates retreat. I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I

In consideration for my being allowed to participate in these activities offered, I, the undersigned hereby release ELR, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participations in these activities including those allegedly attributed to negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. Indemnification.

The participant recognized that there is risk involved in the types of activities offered. Therefore the participant accepts full financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the releasees, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless ELR and the hosting organization, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered.
